State of Florida v. Jessica Jean Mulero

DOB: 12/24/1979

Case Number: 2021 305252 CFDB

Volusia County Defendant Convicted for Crashing into Motorcycle, Killing Couple

DAYTONA BEACH – After a two-day trial Wednesday evening, a Volusia County jury found defendant Jessica Mulero guilty as charged of two counts of DUI Manslaughter and DUI with Damage Person/Property.

On the evening of June 28, 2021, while under the influence of alcohol, the defendant attempted to make a left turn onto Mason Avenue from North Ridgewood Avenue in Daytona Beach when she struck a motorcycle in the intersection. Mulero did not have the right of way as she had a flashing yellow traffic arrow and should have yielded to the motorcycle, which had a green traffic light.

The passenger of the motorcycle died from her injuries at the scene. The driver of the motorcycle died later at the hospital. The defendant’s Blood Alcohol Concentration (BAC) was .17, which is more than twice the legal limit.

“Two people lost their lives because the defendant made the deadly decision to drive drunk,” State Attorney R.J. Larizza said about the case. “As the holiday season approaches, this should serve as a reminder to drink responsibly and drive sober.”

The case was investigated by the Daytona Beach Police Department with assistance from the Volusia Sheriff’s Office and Holly Hilly Police Department. Assistant State Attorney Kevin Sullivan successfully tried the case for the state. The Honorable Raul Zambrano presided over the case and will pronounce sentence at a later date. Mulero faces up to 31 years in prison for the crimes.
